1. Acceptance of Terms
By accessing or using the Aperture Academy website (the "Site") and/or enrolling in any of our photography courses (the "Courses"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree to these Terms, please do not use the Site or enroll in the Courses.
Aperture Academy reserves the right to modify these Terms at any time without prior notice. Your continued use of the Site or enrollment in the Courses after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates or changes.
2. Course Enrollment and Payment
2.1 Enrollment
Enrollment in Aperture Academy courses is subject to availability and acceptance of your application. We reserve the right to refuse enrollment to any applicant at our sole discretion.
2.2 Payment
All course fees are listed on the Site and are subject to change without notice. Payment for courses must be made in full at the time of enrollment, unless otherwise agreed in writing with Aperture Academy. We accept payments via credit card, debit card, and bank transfer.
If you fail to pay the course fees in full, we reserve the right to cancel your enrollment and deny you access to the Course.
2.3 Cancellation and Refunds
Cancellations made more than 14 days before the course start date will receive a full refund, less a $50 administrative fee. Cancellations made between 7 and 14 days before the course start date will receive a 50% refund. No refunds will be issued for cancellations made less than 7 days before the course start date.
Aperture Academy reserves the right to cancel or reschedule a course due to unforeseen circumstances. In such cases, enrolled students will be offered a full refund or the option to transfer their enrollment to another course.
3. Intellectual Property
3.1 Ownership
All content on the Site and within the Courses, including but not limited to text, graphics, logos, images, videos, and software, is the property of Aperture Academy or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or modify any content without our express written permission.
3.2 User Content
If you submit any content to the Site or to Aperture Academy, including but not limited to photographs, comments, or feedback, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or control all rights to the content you submit and that the content does not infringe the rights of any third party.
4. User Conduct
You agree to use the Site and Courses in a respectful and lawful manner. You may not:
- Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Interfere with or disrupt the Site or Courses, or servers or networks connected to the Site or Courses.
- Violate any applicable laws or regulations.
- Attempt to gain unauthorized access to any portion of the Site or Courses, or any other systems or networks connected to the Site or Courses.
- Use any robot, spider, scraper, or other automated means to access the Site or Courses for any purpose without our express written permission.
Aperture Academy reserves the right to terminate your access to the Site and Courses if you violate these Terms.
5. Limitation of Liability
To the fullest extent permitted by applicable law, Aperture Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Site or Courses; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Site or Courses; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Site or Courses by any third party; (e) any errors or omissions in any content; or (f) any other matter relating to the Site or Courses, even if Aperture Academy has been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Site or Courses shall not exceed the amount you paid to us for the specific Course in question.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Sydney, New South Wales, Australia, and you consent to the personal jurisdiction of such courts.

8. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
9. Entire Agreement
These Terms constitute the entire agreement between you and Aperture Academy relating to your use of the Site and enrollment in the Courses, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Aperture Academy with respect to the Site and Courses.
